Contest Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. BY ENTERING THIS CONTEST, ENTRANTS ACCEPT AND AGREE TO BE BOUND BY THESE OFFICIAL RULES.
1. Eligibility. The Weardrobe Time After Time Contest (the "Contest"), sponsored by Market Publique and Like.com (“Sponsors”), is open to all Weardrobe.com users. Officers, directors, and employees of Like.com, Inc. and any other party having responsibility for the development or administration of this Contest, and the immediate family members (i.e., parents, children, siblings, spouse) of the foregoing, are prohibited from entering the Contest. Any violation of the Official Rules may result in disqualification. By participating, entrant (and entrant’s parent/legal guardian if entrant is a minor) agrees to these Official Rules and the decisions of Like.com, Inc. and/or judges, which are final and binding in all matters relating to this Contest. Contest is void where prohibited.
Entrants must be residents of the United States or Canada.
2. Entry Period. All entries must be received between June 21st, 2010 and July 18th, 2010 (the "Entry Period").
3. How to Enter the Contest. During the Entry Period, visit http://www.weardrobe.com/contests/ and follow the instructions posted on the website. Entrants will be asked to photograph themselves in an outfit according to the Contest theme outlined in the contest rules. Entrants may submit an unlimited number of entries. Voting on photos will take place through the duration of the Entry Period. Anyone can register on the site and vote for any photo.
Entrants represent and warrant that their entries are the original works of such entrant, have not been copied from others, and do not violate the rights of any other person or entity. Each entrant consents to have the entry made available for public viewing on the Internet and subject to public comment. Public comments will have no bearing on the selection of the finalists.
4. Winner Selection & Notification. At the conclusion of the entry period, the top 25 entrants with the highest number of votes will be designated as "finalists". If an entrant submits more than one entry, the entry with the highest number of votes will be counted. These entries will be judged on their aesthetic appeal by the Market Publique (“Sponsor”) editorial team. One photo will be selected as the winner. On or about July 27th, 2010, the winner will be contacted by Like.com, Inc. via the email address associated with their Weardrobe account. If any potential winner does not respond within seven (7) days of notification, the prize will be forfeited and an alternate winner will be chosen. If the winner does not respond within the time specified, the winner forfeits all rights to the prize and an alternate winner may be selected.
5. Prize: Winner will receive a photo shoot with Market Publique and will be included in an upcoming lookbook to be used on Market Publique’s Web site. Winner will receive up to $400 for airfare and up to $400 for lodging accommodations for a trip to New York City, which is where Market Publique is based.
6. Taxes. All federal, state and local taxes are winner’s sole responsibility. Like.com, Inc. shall not have any obligation to pay any taxes related to the prize.
7. Ownership and License. All entries submitted in connection with the Contest automatically become the property of Like.com, Inc. In exchange for the opportunity to participate in this Contest, each entrant assigns to Like.com, Inc. all right, title and interest in and to the entry. Each entrant acknowledges and agrees that, once submitted and assigned, the entrant has no further rights to the entry and additional application materials. Each entrant further grants to Like.com, Inc. the unrestricted, irrevocable, perpetual, transferrable, sublicensable, worldwide, but not the obligation, to use the entrant’s name, photograph, picture, likeness, moving image, voice, biographical material, and personal information, whether in their original form as submitted on the entry and additional application materials, or as altered, edited, lifted or reproduced by Like.com, Inc., whether in connection with the Contest or not, in any and all media for any and all purposes, without any payment to, or further authorization by, the entrant.
8. Liability Limitations: Participation in the Contest constitutes agreement by entrant that Like.com, Inc, family, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents are released from, will have no liability whatsoever for, and shall be held harmless by entrant (and an entrant’s parent/ legal guardian, if entrant is a minor) against any and all claims, losses or liabilities (including death or property damage) arising out of or relating to participation in this Contest or any Contest-related activities or use or misuse or redemption of a Contest prize.
9. Disclaimers. (i) Entries that are lost, received after the deadlines stated herein, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Like.com servers or elsewhere, will not be eligible for consideration in the Contest. Entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. (ii) Like.com, Inc., in its sole discretion, reserves the right to disqualify any person that it determines has tampered with the entry process, the integrity of the Contest, or the operation of the Weardrobe web site. Use of bots or other automated process to enter the Contest is prohibited and may result in disqualification at the sole discretion of Like.com, Inc. (iii) Like.com, Inc. further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. (iv) Like.com, Inc. is not responsible for errors in the administration or fulfillment of this Contest, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Contest based upon such error at its sole discretion without liability. (v) LIKE.COM, INC. MAKES NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. (vi) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE COUTURIOUS.COM WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, LIKE.COM, INC. RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
10. Miscellaneous. This Contest is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of California. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, and the parties hereby submit and consent to the exclusive jurisdiction and venue of the federal and state courts located in San Francisco, California. These Official Rules will bind all contestants, and their respective heirs, representatives, successors and permitted assigns. These Official Rules supersede any prior oral or written agreements relating to rules or procedures for the Contest. These Official Rules will not be construed to impose upon Like.com, Inc. any obligations for any losses, debts or other obligations incurred by any Contest participant.
11. Privacy Policy. All information collected from entrants, including e-mail addresses, is subject to the Privacy Policy of the Like.com, Inc.
